In any conflict between language versions, the Hebrew version prevails.
1. Definitions
1.1 “Catalog Piece” – A standard design offered on the website, produced individually and made-to-order, without unique customization by the customer.
1.2 “Custom Piece” – Any piece including one or more of the following:

Engraving (names, initials, dates, numbers).

Special stone selection or customer-supplied stones.
-
Deviation from standard catalog sizes.
-
Design modifications, sketches, or structural adjustments.
-
Any personalization approved in writing.
Custom Pieces fall under the legal definition of goods manufactured specifically according to the consumer’s request under Section 14C of the Israeli Consumer Protection Law and are generally not cancellable after production begins.
2. General
2.1 The website www.noahkaplandesign.com (the “Website”) is operated by Noah Kaplan Design, a handmade jewelry studio based in Herzliya, Israel (“the Studio”, “we”, “us”).
2.2 Use of the Website and any purchase constitutes acceptance of:

the Warranty & Repairs Policy,

the Privacy Policy.
2.3 Nothing in these Terms limits non-waivable consumer rights under Israeli law. In any conflict, the law prevails.
3. Eligibility
3.1 Purchases may be made only by individuals age 18 and above with legal capacity to enter binding agreements.
3.2 Business entities are subject to the B2B rules in Section 16 below.
4. Nature of Products – Handmade Characteristics
4.1 All jewelry is handcrafted and made-to-order.
4.2 Natural materials (gold, silver, diamonds, gemstones) vary in color, inclusions, clarity, texture, and measurements. Such variations are not manufacturing defects.
4.3 Images on the Website represent general design and may vary due to photography and screen settings.
4.4 Each piece, whether Catalog or Custom, is individually produced for the specific order.
5. Orders, Contract Formation & Payment
5.1 Placing an order constitutes an offer to purchase.
5.2 A binding agreement is formed when:

an order confirmation is sent by the Studio, or
-
production of the piece begins,
whichever occurs first.
5.3 Prices are listed in ILS unless otherwise stated and do not include customs, import taxes, duties, VAT outside Israel, or shipping fees.
5.4 The Studio may correct clear pricing errors and cancel orders based on such errors with full refund of the incorrect portion.
5.5 Full payment is required before production begins unless otherwise agreed in writing.
5.6 Deposits paid for Custom Pieces are non-refundable once design work, stone sourcing, or any production-related work has begun.
6. Cancellations, Returns & Exchanges
6.1 Under Section 14C of the Consumer Protection Law, the right of cancellation does not apply to goods manufactured specifically according to the consumer’s request.
6.2 Custom Pieces
Not cancellable and not returnable once production begins, except in cases of verified manufacturing defects.
6.3 Catalog Pieces
May be eligible for cancellation before production begins or return within the period defined in the Shipping & Returns Policy, provided that the item is:

unworn,
-
unused,
-
in original packaging and condition,
-
not hygiene-sensitive (e.g. certain earrings),
-
not marked as “Final Sale.”
6.4 Studio Rights
The Studio does not refuse lawful returns but retains the right to classify items as Custom based on the definitions above.
7. Shipping & Delivery
7.1 Production and shipping timelines are estimates.
7.2 Delays caused by couriers, customs, or external circumstances—including war, mobilization, national emergencies, or supply-chain disruptions—do not constitute breach.
7.3 Risk of loss transfers upon confirmation of delivery by the courier (scan, signature, or equivalent proof).
8. Force Majeure
The Studio is not liable for delay or inability to supply caused by:

war, terror events, reserve duty mobilization,
-
national or regional emergencies,
-
courier disruptions,
-
shortages of materials,
-
government orders or closures,
-
natural disasters or force majeure events.
Where possible, the Studio will notify customers and provide updated timelines or alternatives.
9. Intellectual Property
All designs, sketches, molds, photographs, models, content, and brand elements appearing on the Website are the exclusive intellectual property of the Studio.
Even for Custom Pieces, design rights remain with the Studio unless expressly transferred in a written agreement signed by both parties.
10. Prohibited Uses
Users may not:

copy, reproduce, or distribute site content,
-
use automated scraping tools,
-
impersonate others,
-
upload harmful or malicious code,
-
use the site in violation of law or third-party rights.
11. Warranty
A summary appears here; the full binding rules appear in the Warranty & Repairs Policy.
12. Limitation of Liability
12.1 For consumers: liability is limited only to the extent permitted by Israeli law.
12.2 For business customers (B2B): the Studio’s maximum liability is limited to the total amount paid for the order.
12.3 The Studio is not liable for consequential or indirect damages, or losses arising from misuse, accidental damage, or natural characteristics of handmade and natural materials.
13. Indemnification
Users agree to indemnify the Studio for damages caused by unlawful use of the Website or breach of these Terms, to the extent permitted by law.
14. Governing Law & Jurisdiction
These Terms are governed exclusively by the laws of the State of Israel.
Exclusive jurisdiction is vested in the competent courts of Tel Aviv–Jaffa.
15. Language Priority
If there is any discrepancy, the Hebrew version prevails.
16. B2B Purchases
Consumer cancellation rights do not apply to business-to-business (B2B) purchases.
Returns and cancellations for B2B transactions are contractual only.
Liability limitations may apply more broadly.
